Agreement to Terms

By accessing or using Relate ("the Service," "the App," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Important Disclaimers

Not a Substitute for Professional Help

RELATE IS NOT A THERAPY SERVICE AND DOES NOT PROVIDE MEDICAL OR MENTAL HEALTH TREATMENT. The Service provides AI-powered relationship support tools and is not a substitute for professional therapy, counseling, medical advice, diagnosis, or treatment.

• The AI-generated responses are for informational and support purposes only
• The Service should not be used in crisis situations or for emergencies
• If you are experiencing a mental health crisis, suicidal thoughts, or any medical emergency, please contact emergency services (911 in the US) or a crisis hotline immediately
• Always seek the advice of qualified health providers with any questions you may have regarding a medical or mental health condition

No Professional Relationship

Use of the Service does not create a therapist-client, doctor-patient, or any other professional relationship. Our AI assistant is a tool, not a licensed professional.

Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

Account Registration and Security

Account Creation

• You must provide accurate, complete, and current information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized access or security breach

Account Restrictions

You may not:

• Create multiple accounts for yourself
• Share your account with others
• Impersonate another person or entity
• Use another person's account without permission

Acceptable Use

You Agree To:

• Use the Service in compliance with all applicable laws and regulations
• Use the Service only for lawful, personal, non-commercial purposes
• Treat the Service and other users with respect
• Provide truthful information in your conversations

You Agree NOT To:

• Use the Service for any illegal or unauthorized purpose
• Harass, abuse, threaten, or harm others
• Violate any applicable laws or regulations
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers/networks connected to the Service
• Use automated systems (bots, scrapers) to access the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Upload viruses, malware, or other malicious code
• Use the Service to collect information about other users
• Misrepresent your identity or affiliation

Content and Intellectual Property

Your Content

• You retain ownership of the content you create (conversations, journal entries, etc.)
• By using the Service, you grant us a limited license to use your content to provide and improve the Service
• You are responsible for the content you share and must have the right to share it
• You represent that your content does not violate any third-party rights

Our Content

• The Service, including all software, text, graphics, logos, and other materials, is owned by us or our licensors
• You may not copy, modify, distribute, sell, or create derivative works from our content
• "Relate" and our logo are our trademarks and may not be used without permission

AI-Generated Content

• Responses generated by our AI assistant are provided as-is
• We do not guarantee the accuracy, completeness, or usefulness of AI-generated content
• You should not rely solely on AI-generated content for important decisions

Partner Sharing and Communication

Sharing Features

• You can choose to share summaries and messages with your partner through the App
• Once shared, you cannot control what your partner does with that information
• Shared content may be visible to your partner even after you delete it from your account
• You are responsible for deciding what to share and when

No Guarantee of Privacy Between Partners

If you and your partner both use the Service and share information with each other, we cannot guarantee that information remains private between you. Consider carefully before sharing sensitive information.

Subscription and Payment

Subscription Plans

• Certain features require a paid subscription
• Subscription fees are billed in advance on a recurring basis (monthly or annually)
• Prices are subject to change with notice

Payment

• You agree to pay all fees associated with your subscription
• Payment is processed through third-party payment processors
• You authorize us to charge your payment method for all fees

Free Trials

• Free trials may be offered for new subscribers
• You may cancel before the trial ends to avoid charges
• If you don't cancel, you'll be automatically charged when the trial ends

Cancellation and Refunds

• You may cancel your subscription at any time through the App
• Cancellation takes effect at the end of the current billing period
• No refunds for partial periods unless required by law
• Upon cancellation, you will retain access to paid features until the end of your billing period

Termination

By You

• You may delete your account at any time through the App
• Deletion is permanent and cannot be undone
• Upon deletion, your data will be removed in accordance with our Privacy Policy

By Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent activity
• Your use of the Service poses a risk to us, other users, or third parties
• We are required to do so by law
• We cease operating the Service

We will provide notice when reasonably possible, except in cases of violations or legal requirements.

Disclaimers and Limitations of Liability

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: Warranties of merchantability, fitness for a particular purpose, or non-infringement; Warranties that the Service will be uninterrupted, secure, or error-free; Warranties regarding the accuracy, reliability, or completeness of content.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• WE ARE NOT LIABLE FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM

Specific Disclaimers

• We are not responsible for relationship outcomes or decisions made based on the Service
• We are not liable for any harm arising from reliance on AI-generated content
• We are not responsible for technical issues, including data loss or service interruptions
• We are not liable for actions taken by your partner or third parties

Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit or share

Dispute Resolution

Informal Resolution

Before filing a claim, you agree to contact us at admin@startrelate.com to attempt to resolve the dispute informally.

Arbitration Agreement

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration rather than in court, except: Small claims court disputes; Claims for injunctive or equitable relief; Intellectual property disputes.

You may opt out of this arbitration agreement by sending written notice to admin@startrelate.com within 30 days of first using the Service.

General Provisions

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting updated Terms in the App with a revised "Last Updated" date, or sending an email or in-app notification. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

Other Provisions

• If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect
• These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service
• Our failure to enforce any right or provision does not constitute a waiver of that right or provision
• You may not assign or transfer these Terms without our written consent
